Affiliate Program – Terms and Conditions

These Terms and Conditions (“Terms”) apply exclusively to affiliates of Sacred-Gems.com and the customers they refer. By promoting, referring, or purchasing via an affiliate link, both the affiliate and the customer agree to the following legally binding terms.

1. Legal Entity

Sacred-Gems.com is operated as a sole proprietorship under the personal Business Registration Number (BRN) of its owner in Mauritius. All affiliate operations, payments, and legal matters fall under the jurisdiction of Mauritian civil law.

2. Commission Structure (For Affiliates Only)

• Affiliates will earn a flat 10% commission on the base price of any product sold through their unique affiliate link.

• Commissions do not apply to taxes, shipping, discounts, handling fees, or returns.

• Commission is earned only on completed and paid orders that are not cancelled or refunded.

• Payouts are processed on a monthly basis, subject to a minimum threshold of USD [$XX].

• It is the affiliate’s responsibility to provide accurate payment details. Sacred-Gems.com is not liable for delayed or failed transfers due to incorrect information.

3. Affiliate Code of Conduct

Affiliates must:

• Only promote using accurate and honest information.

• Never claim medical, healing, or spiritual results from gemstones.

• Avoid spam, misleading ads, or unauthorized use of Sacred-Gems.com branding.

• Refrain from unethical marketing tactics, impersonation, or fake testimonials.

Violation of any part of this clause will result in immediate removal from the program and forfeiture of unpaid commissions.

4. Customer Disclosure (for referred buyers)

Customers referred by affiliates must understand:

• Sacred-Gems.com sells natural gemstones and handcrafted jewelry, not medical or spiritual cures.

• All gemstones are described to the best of our ability; slight variations in color, shape, and inclusions may occur.

• Claims related to metaphysical, spiritual, or astrological outcomes are subjective and not guaranteed.

All purchases are final unless the item is proven inauthentic or grossly misrepresented. Any issues must be reported within 7 calendar days of delivery.

5. Shipping and Customs

• Sacred-Gems.com ships internationally via reliable courier services.

• Buyers are responsible for customs duties, import taxes, and regulatory clearance in their country.

• Sacred-Gems.com is not liable for delays, damages, or loss occurring after shipment has been dispatched.

6. No Warranty or Guarantee

We make no warranties, express or implied, regarding:

• Healing, spiritual, or metaphysical results.

• Compatibility with personal belief systems.

• Astrological accuracy or outcomes.

Affiliates must never promise or guarantee specific results from gemstones to customers. Sacred-Gems.com will not be liable for claims made by affiliates outside the boundaries of these Terms.

7. Limitation of Liability

Sacred-Gems.com and its owner will not be liable for:

• Lost commissions due to customer cancellations, fraud, or returned orders.

• Damages resulting from reliance on affiliate claims.

• Legal issues between affiliates and their customers.

All affiliate and customer dealings must remain transparent and aligned with these Terms.

8. Dispute Resolution and Jurisdiction

All legal disputes or claims arising out of the affiliate program or referred sales:

• Shall be governed exclusively by the laws of Mauritius, under the owner’s personal BRN.

• Must be resolved solely in the Civil Courts of Mauritius.

• Class actions, third-party arbitrations, or lawsuits outside this jurisdiction are strictly prohibited.

9. Modifications to These Terms

Sacred-Gems.com reserves the right to amend or update these Terms at any time. Affiliates and referred customers are responsible for reviewing them periodically.

Continued participation in the affiliate program or use of affiliate links indicates acceptance of the latest version.
